GUWAHATI: In a historic move, after a five-hour debate and a walkout by the Congress and the AIADMK, the Lok Sabha on December 27 passed which criminalises the practice of instant triple talaq in the Muslim community.
The Muslim Women (Protection of Rights on Marriage) Bill 2018 was passed by the Lower House with 245 voting in favour and 11 opposing the legislation.
The proposed law makes "triple talaq" an offence with a jail term of up to three years and a fine for the husband, and makes the woman entitled to maintenance.
However, the bill will now go to Rajya Sabha for approval.

Law minister Ravi Shankar Prasad said the bill should not be seen through the "prism of politics" but of humanity. He also pointed out that the Supreme Court had called instant Triple Talaq "unconstitutional" and asked the government for a law against it.
The bill got its shape after the then CJI JS Khehar- led bench of the Supreme Court in 2017 struck off the practice of triple talaq and stated that the practice of instant talaq was not a part of Islam and violative of Article 14 and 21 of the Constitution.
