Gauhati High Court Orders Action On Pending Cases Against MPs And MLAs

 

GUWAHATI: The Gauhati High Court issued strict directives on Tuesday, March 11 concerning the slow progress of cases pending against Members of Parliament (MPs) and Members of Legislative Assemblies (MLAs) in district courts. Many of these cases remain unresolved due to procedural delays, the non-appearance of the accused, and legal obstructions.

A bench comprising Justice Suman Shyam and Justice Arun Dev Choudhury has instructed the concerned authorities to submit a comprehensive report on the status of these cases. The registrar has been specifically tasked with overseeing the matter and ensuring compliance with the court’s directive.

The High Court has mandated the submission of a detailed list of cases that are currently under a stay order.

The court directed the Registry to call for specific information from the concerned authorities to ascertain the reasons as to why, these matters have remained pending for so long without any progress. The report should also indicate the steps that were taken by the concerned Presiding Officers of those courts to expedite the disposal of these cases over the past several years. The report is said to be placed on or before the next writ petition which will be listed on April 29.

One of the major reasons behind the delay in resolving these cases is the failure of accused legislators to appear before the court on time.

Additionally, irregularities in the submission of evidence and frequent stay orders issued by higher courts have further hindered the judicial process.
