Assam Government criticised for Violating Respect and Dignity of Transgender Community

GUWAHATI: The All Assam Transgender Association (AATA) has mentioned that a cruel definition of transgender was written in the draft state policy on transgenders formulated by the Social Welfare Department of Assam. This complaint was submitted as a memorandum to Social Welfare Minister, Pramila Rani Brahma. 

The AATA has alleged that the transgender definition in the draft policy violates the respect, dignity and prestige of the transgender community and the NALSA judgement as well, according to a report published in The Assam Tribune.

Based on the policy, transgenders have been defined as people who are neither wholly female nor wholly male. They are not a combination of female and male and their sense of gender does not match the gender assigned to them at birth. It includes trans-men, trans-women, people with intersex variations and gender-queers. 

The AATA has stated in the memorandum submitted that the current policy includes people with intersex variations under the transgender umbrella. However, sex and gender are both different concepts, and cannot be merged together as under one category.

The AATA explained that while sex is a biological or medical term to denote male, female and intersex, gender is a deep sense of self as a gendered being and may not have a one-to-one correlation with sex.
