GUWAHATI: In commemoration of Republic Day 2025, the Assam government announced a remission of sentences for specific categories of prisoners convicted by courts in the state.

The remission, effective from January 26, excludes certain offenses and aims to honour the spirit of the national celebration while providing relief to eligible inmates.
The Governor of Assam, exercising the powers under Article 161 of the Constitution and Section 473 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has granted sentence reductions to prisoners serving rigorous imprisonment, as per the following scale:
-Prisoners with sentences exceeding 1 year: 30 days remission
-Prisoners with sentences between 6 months and 1 year: 15 days remission
-Prisoners with sentences between 3 months and 6 months: 10 days remission
-Prisoners with sentences between 1 month and 3 months: 5 days remission
The remission does not apply to prisoners convicted under specific offenses or laws, including:
1. Prisoners sentenced to simple imprisonment in lieu of fines.
2. Offenses under the Foreigners Act.
3. Offences under the Passport Act.
4. Foreign nationals convicted under any law.
5. Offenses under Sections 3-10 of the Official Secrets Act, 1923.
6. Crimes against the state under Sections 147-159 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
7. Convictions under the Prevention of Corruption Act.
8. Offenses under Sections 126/128 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
9. Crimes extending to the executive powers of the Union.
10. Violations under the Prevention of Food Adulteration Act .
11. Suppression of Immoral Traffic Act.
12. Convictions under the Narcotics Drugs and Psychotropic Substances Act, 1985 (NDPS Act).
13. Prisoners convicted of rape.
