GUWAHATI: After a lengthy nine-year trial, Deepmoni Saikia, the primary accused in the 2014 Assam Medical College and Hospital (AMCH) murder case, was acquitted of all charges related to the murder of Sarita Toshinwal. While clearing Saikia of the accusations, the Dibrugarh District & Session Judge Court on Thursday convicted Kiru Mech, the ward boy, in the murder under Section 302 and sentenced him to life imprisonment.
The court's decision comes nearly a decade after the brutal killing of Sarita Toshniwal, a medical student at AMCH, on May 9, 2014.
As per media reports, the court has acquitted the junior doctor Deepmoni Saikia, while Kiru Mech was convicted under Sections 302 of the Indian Penal Code (IPC).
It may be mentioned that Sarita Toshinwal (24), a postgraduate medical student in the obstetrics and gynaecology department at AMCH, was brutally murdered in the intensive care unit (ICU) of the gynaecology department on May 9, 2014.
Based on the examination of the deceased's phone records, the police arrested the junior doctor Deepmoni Saikia. Subsequently, on May 10, 2014, Kiru Mech was arrested after he confessed to the crime, citing repeated belittlement by the deceased doctor.
While talking to G Plus, Gaurav Somani, who has been associated with the Toshinwal family since the incident said, “We are demanding a reinvestigation into the whole matter. We believe that the evidence was not analysed and scrutinised properly. There have also been several loopholes in the investigation.”
“We will apply to the higher court against the acquitted Deepmoni Saikia. He has to come under the ambit of law,” Somani further added.
Somani said, “The case was handed to CID which was shifted to a fast-track court. A committee was formed by then Chief Minister Tarun Gogoi to probe the incident which was led by IAS Prateek Hajela.”
An ex gratia of ₹5 lakh was given to the Toshinwal family and a hostel was named after her in Assam Medical College, Dibrugarh.
The final sentencing was pronounced on Thursday after arguments from both parties were heard.
