GUWAHATI: The Gauhati High Court ruled on Wednesday, January 8, that breakups and heartbreaks are a part of life, and such situations do not constitute instigation for suicide.

After reviewing arguments from opposing parties, the court held that breaking up in a relationship can be an emotionally challenging affair, but it is also a common experience and does not equate to instigation for committing suicide. The court observed that the circumstances did not justify the accused’s arrest.
This observation was made while granting bail to one Raj Kapil Khaound, who was arrested for allegedly abetting the suicide of a 30-year-old woman on New Year’s Eve in Guwahati. The case had risen following an FIR filed by the deceased woman’s mother at Chandmari Police Station.
Khaound, who was in a previous live-in relationship with the deceased, was subsequently arrested by the police. However, representing the accused, advocates Bijon Mahajan and Arshad Chaudhury argued that Khaound’s arrest was based on allegations of mental harassment, which promptly led the woman to depression.
The two lawyers further contended that such allegations did not amount to instigation or abetment of suicide. They also cited the Supreme Court’s decision from an earlier case, emphasising that heartbreak or emotional distress alone cannot be considered grounds for abetment charges.
The court granted bail to Khaound on a bond of ₹20,000, to be submitted to the Chief Judicial Magistrate, Kamrup (Metro), Guwahati. Meanwhile, another individual, Manab Jyoti Koch, who had been living with the deceased for three months prior to her death, has also been arrested and remains in judicial custody for the time being.
