GUWAHATI: The Union government is in the last stages of finalising a proposal to amend the Aadhaar Act to give all citizens an option to withdraw their Aadhaar number, including biometrics and data.

It is to be mentioned that according to the petitioners, Aadhaar is a serious invasion into the right to privacy of persons and it has the tendency to lead to a surveillance state where each individual can be kept under surveillance by creating his/her life profile and movement as well on his/her use of Aadhaar.

On September 26, 2018, a Constitution Bench of the Supreme Court, led by then Chief Justice of India Dipak Misra upheld the validity of Aadhaar but with riders.

Justice D.Y. Chandrachud, in his dissenting judgment, said that passing the Aadhaar Act as a Money Bill was a fraud on the Constitution. He also held section 7 of the Act, which makes Aadhaar mandatory for state subsidies, as unconstitutional.
