SC Disposes Of Petition Over Waqf Property Dispute In Guwahati's Fancy Bazar

 

GUWAHATI: The Supreme Court has disposed off a Special Leave Petition (SLP) filed by Abedur Rahman alias Charles Rohman and others against the Assam Board of Wakf, resolving a long-standing dispute concerning a Waqf property at Fany Bazar in Guwahati.

The case, arising from the Gauhati High Court’s judgment, addressed the condition of the descendants of Late Ohidur Rahman,  who are reportedly mentally challenged. To amicably resolve the issue, the Assam Board of Wakf has agreed to lease the first and second floors of a dwelling house to the descendants at a nominal rent. This arrangement will ensure that the descendants, who are in need of support, will retain peaceful possession of the property during their lifetime.

The Board’s proposal was put forth in a statement during the hearing on November 22, indicating that the lease agreement would comply with the Waqf Properties Lease Rules, 2014. As for the remaining portion of the Waqf estate, the Assam Board of Wakf will continue to manage, control, and administer it under the provisions of the Waqf Act, 1995.

The Supreme Court took note of the proposal and disposed of the Special Leave Petition, while also addressing any pending applications. The court’s order seeks to bring an amicable resolution to the dispute and ensure the welfare of the affected family members.
