GUWAHATI: The Gauhati High Court recently directed all subordinate courts in Assam to dispose of pending execution petitions within six months. It has been stated that failing to do so will make the concerned presiding officers answerable to the High Court.

The directive was issued in compliance with a Supreme Court order dated March 6, where the latter had instructed all High Courts across the country to ensure timely disposal of execution petitions in trial courts.
The bench, comprising Justice J.B. Pardiwala and Justice Pankaj Mithal, also ordered the High Courts to collect data on execution petition pendency from district courts and issue administrative circulars ensuring their resolution within six months. Additionally, the Supreme Court stated that non-compliance would make the respective presiding officers answerable to the High Courts.
The order has come following previous Supreme Court rulings emphasising the need for timely execution of judgments, since it had mandated that execution proceedings should be completed within six months from the date of filing. However, the court observed that delays continue to persist.
This move has been enforced to expedite legal processes and ensure timely enforcement of court judgments in Assam.
