Gauhati HC Asks Assam Govt For Post Mortem, Viscera Reports In Alleged Police Torture Death Case

GUWAHATI: The Gauhati High Court has asked the state of Assam to present before it the post-mortem report and the viscera report of Dipankar Gogoi in a petition demanding the CBI investigation into his death. The directive was issued by a division bench comprising justices Manash Ranjan Pathak and  Malasri Nandi.

A criminal writ petition was filed by Rimly Gogoi, sister of the deceased, alleging that he was brutally tortured and given third-degree torture by the Jorhat and Titabar police led by Mohanlal Meena, before his death.

Respondents are the State of Assam, Mohanlal Meena, Kakoli Patgiri, SDPO, Lakhsman Kumar Das, OC Titabar PS (R4) and Miraj Doley  IO of the case. The court also asked the petitioner to implead the DGP and current SP of Jorhat.

Arif Jwadder, counsel for the petitioner argued and appeared for the petitioner. the Government advocate appeared on behalf of the state of Assam.

A shocking case of alleged custodial torture in Assam led to legal battle at the Gauhati High Court. Rimly Gogoi Saikia, a resident of Jorhat district, filed a writ petition seeking an independent probe into the alleged police brutality that led to the death of her brother Dipankar Gogoi.

According to the petition, on December 22, 2023, Dipankar was taken into custody by Titabar police as a suspect in the Lichubari bomb blast case. Over the next four days, he was allegedly subjected to repeated physical and mental torture at the hands of Jorhat police, including then-Superintendent of Police (SP) Mohan Lal Meena. Despite being released each night, Dipankar's family claims that he was coerced, threatened, and even given unidentified medicines by the officers.

On December 26, 2023, Dipankar was found hanging from a tree near his house. While police classified his death as a suicide, his family has accused law enforcement of systematic torture that led him to take his own life. They claim that CCTV footage and medical records fail to capture the full extent of the abuse he suffered.

Rimly Saikia has urged the court to transfer the investigation to the Central Bureau of Investigation (CBI), citing a lack of trust in the Assam Police. She has also requested compensation for her family and legal action against the officers involved.
