The petition from the ruling party in Tamil Nadu, filed by the party’s Deputy General Secretary and Lok Sabha MP A. Raja, has contended that the Act violates the fundamental rights of nearly 50 lakh Muslims in Tamil Nadu and approximately 20 crore Muslims across India.

The petition has been settled by Senior Advocate P. Wilson, who is also a DMK Rajya Sabha MP. It has argued that the controversial amendments were enacted without adequate consideration of the objections raised by DMK members, both during the deliberations of the Joint Parliamentary Committee and the debate in Parliament.

The Tamil Nadu Legislative Assembly had earlier, on March 27, had also passed a resolution urging the central government to withdraw the Bill.

Relatedly, The Waqf (Amendment) Act, which recently received presidential assent, has drawn criticism from various quarters. Several writ petitions have already been filed in the Supreme Court, challenging the legislation on similar grounds.

Among the petitioners are the Samastha Kerala Jamiatul Ulema, a prominent Sunni Islamic scholars’ body from Kerala, and political leaders such as AIMIM chief Asaduddin Owaisi and Congress MP Mohammad Jawed. Their petitions have argued that the amendments impose discriminatory control over Islamic charitable properties and infringe upon constitutionally guaranteed rights.
