GUWAHATI: Aftab Uddin Mollah, the Congress MLA who was apprehended on Wednesday over allegations of delivering a "hate speech" targeting Hindu priests and namgharias, secured bail from a local court in Guwahati on Thursday.
The Chief Judicial Magistrate of Kamrup (Metro) released the MLA on a Personal Recognisance (PR) bond.
Mollah's legal counsel, senior advocate Angshuman Bora, presented arguments before the court, contending that the arrest did not adhere to proper legal procedures.
Bora highlighted that the investigators failed to follow the rule of law, particularly concerning the stipulated time for the accused to appear before the police under Section 41 of the Criminal Procedure Code (CrPC) and the timing of the arrest.
Citing a Supreme Court precedent, Bora successfully advocated for the release of the Congress MLA.
The controversy erupted after a video clip of Mollah's speech at a party workers' meeting in Goalpara surfaced on social media.
In the video, Mollah was seen blaming temple priests and Namgharias, priests of the Vaishnavite sect, for their alleged involvement in criminal activities.
