The plea, filed by an Advocate-on-Record, points to Dubey’s controversial statements in which he claimed the Supreme Court was "leading the country toward anarchy" and blamed CJI Sanjiv Khanna for "the civil wars taking place in the country." These remarks were reportedly made in response to the Supreme Court’s recent directions setting deadlines for the President and Governors to act on pending legislation.
Additionally, the plea notes that Dubey made communally sensitive comments while criticizing the Court’s involvement in petitions challenging amendments to the Waqf Act, further heightening concern over the potential impact of his rhetoric.
Filed under Section 15(1)(b) of the Contempt of Courts Act, the petition submitted to Attorney General R. Venkataramani describes Dubey's statements as “deeply derogatory” and “provocative in nature.” The letter argues that such accusations not only undermine the dignity of the judiciary but also attempt to stir public anger and unrest by targeting the country’s highest judicial authority.
“These reckless comments unfairly link national instability to the Chief Justice, thereby scandalising the office and threatening the independence of the judiciary,” the petition states, calling for criminal contempt proceedings against Dubey.
Following widespread backlash, BJP National President JP Nadda distanced the party from Dubey’s remarks, stating that they were made in a personal capacity and did not reflect the party’s stance.
