Gauhati High Court: Legal Heirs Of Person Driving Borrowed Vehicle Cannot Claim Compensation For Injury Or Death

GUWAHATI: The Gauhati High Court recently ruled that the legal heirs of a person driving a borrowed vehicle are not entitled to claim compensation for injury or death.

This decision came as the court overturned a judgment by the Motor Accident Claims Tribunal, which had awarded ₹2,54,000 in compensation to the legal heirs of a deceased man. The incident occurred on August 12, 2006, when the deceased borrowed a motorcycle from Gautam Roy Choudhury.

Unfortunately, the bike was involved in an accident, resulting in the man's death. Following his death, a claim for compensation under Section 163A of the Motor Vehicles Act, 1988, was filed before the Motor Accident Claims Tribunal in Kamrup.
