Gauhati HC Reserves Orders In Contempt Pleas By Assam Advocate General Against Three Advocates

 

GUWAHATI: The Gauhati High Court has reserved its orders in two contempt petitions filed by the Advocate General of Assam, Devajit Saikia, against three advocates for making "scandalous" comments.

The petitions state that the respondents, Kamal Nayan Choudhury, Pallavi Talukdar and Anil Kumar Bhattacharyya have made “scandalous remarks” against a judge and the high court.

A division bench led by Chief Justice Vijay Bishnoi and Justice Unni Krishnan Nair heard the petitions on Tuesday, April 8. After hearing arguments from all parties involved, the court reserved its orders.

The alleged comments were made during a sit-in by members of the Gauhati High Court Bar Association (GHCBA), while protesting against the proposed relocation of the high court to North Guwahati. The association has raised concerns about accessibility, disruption to ongoing legal processes, and the preservation of the court’s institutional legacy.

Adding to the controversy, Assam Advocate General Devajit Saikia recently resigned from his membership of the GHCBA due to disagreements over the proposed move. In a letter to the association’s president, Saikia explained that his official responsibilities required him to support the state government and the high court’s decision.

Saikia defended the relocation, stating it was necessary to address infrastructural deficiencies and create a more modern, efficient environment for the legal community. “I fully support the decision to shift the High Court to the new site, which promises a significantly improved working atmosphere for current and future members of the legal profession,” he wrote.

Despite his stance, Saikia acknowledged the divide between the Bar Association and the government, noting that the differences could lead to a conflict of interest.
