Gauhati HC Orders Status Report On Pending Cases Involving MPs And MLAs

 

GUWAHATI: The Gauhati High Court has directed the Registrar General to submit a status report detailing the number of pending cases, their current status, and stay orders in cases related to Members of Parliament (MPs) and Members of Legislative Assembly (MLAs) from the four states under its jurisdiction: Assam, Nagaland, Mizoram, and Arunachal Pradesh.

The directive was issued by a Special Bench comprising Justice Suman Shyam and Justice Arun Dev Choudhury in a suo moto proceeding initiated in compliance with a Supreme Court judgement dated November 9, 2023, which outlined guidelines for the speedy resolution of cases involving MPs and MLAs.

"The cases pending against the MPs/MLAs in the four states—Assam, Nagaland, Mizoram, and Arunachal Pradesh—are listed in the table in paragraph 12 of the Supreme Court's order dated November 9, 2023. However, we do not find an updated status report on record for passing new orders," the High Court observed.

To facilitate further proceedings, the Court directed the Registrar General to provide a detailed report containing the number of cases along with the current status of the cases pending before the Principal Seat at Guwahati and the outlying Benches of the Gauhati High Court concerning MPs and MLAs as well as information on any stay orders affecting the expeditious trial or disposal of these cases, including specific details.

Additionally, the Court instructed that a similar exercise be conducted to gather information on cases pending before the District Courts and Special Judges across Assam, Nagaland, Mizoram, and Arunachal Pradesh. The High Court has set May 31 as the deadline for the Registrar General to submit the status report.
