‘AI Is Biased, Remember That It’s Man-Made Machine,’ Notes SC Judge Justice Surya Kant

 

GUWAHATI: Supreme Court judge Justice Surya Kant has raised caution over the increasing reliance on artificial intelligence, remarking that AI systems continue to carry serious biases and are ultimately man-made. His comments came during a recent hearing related to the Krishna River water dispute.

According to a LiveLaw report published on Wednesday, April 23, Justice Kant, while in an exchange with Senior Advocate Jaideep Gupta on the use of technology in legal processes, voiced concerns about the overdependence on AI tools such as ChatGPT and Gemini for factual queries. Referring to their usage in learning about geographical aspects like river tributaries, he said, “At least I don’t do that. I am very afraid of doing that. It’s human nature that when we start depending upon something, we are bound to become used to it.”

The dialogue arose when Gupta, on a lighter note, mentioned that AI could easily provide such answers. However, he quickly turned serious, pointing out the potential risks of losing touch with traditional research skills. “We must not forget our ability to research the source material. If we do that, the ability to authenticate the answer we are getting from AI is lost,” Gupta asserted.

Justice Kant agreed with the concern and added, “We must remind ourselves that this is also a man-made machine,” to which Gupta responded by highlighting that present-day AI carries inherent human biases. Justice Kant responded firmly, “Absolutely, very serious biases.”

Gupta further noted that global efforts are underway to establish ethical frameworks for AI. Citing an example, he said AI should ideally refuse unethical prompts, such as harming or removing a person, and instead warn users about the impropriety of such requests.
