Supreme Court Bar Association Chief Under Fire From Members For Letter To Murmu

 

GUWAHATI: The Executive Body of the Supreme Court Bar Association (SCBA) strongly criticised the letter to the President of India by its President Adish Aggarwala and called it as an attempt to overreach and undermine the authority of the Supreme Court.

Distancing itself from the SCBA president’s action, the Executive Committee in a resolution said, “The entire seven-page letter, having been printed on the letterhead of the All India Bar Association, appears to have been written by Dr Adish C. Aggarwala in his capacity as the Chairman of the All India Bar Association. However, it is noticed that below his signature on said letter he has inter alia mentioned his designation as President of the Supreme Court Bar Association. Therefore, it has become expedient for the Executive Committee of the Supreme Court Bar Association to make it abundantly clear that the members of the committee have neither authorised the President to write any such letter nor do they subscribe to his views as expressed therein.“

“The Executive Committee of the Supreme Court Bar Association further views this act as well as the contents therein as an attempt to overreach and undermine the authority of the Supreme Court of India and unequivocally condemn the same," the SCBA further stated in the resolution.

The SCBA President Adish Aggarwala had issued a letter to the President of India Droupadi Murmu on March 12 in which he requested her to put a hold on the enforcement of the Supreme Court's verdict on electoral bonds until a rehearing is conducted in the interest of 'complete justice' for “the Parliament of India, political parties, corporates and the general public.

This is not the first time Aggarwala has been at odds with the SCBA executive committee, as the SCBA executive body had distanced themselves from his actions after the SCBA president’s letter to the Chief Justice of India, where he sought suo motu action against the protesting farmers amidst the farmers' protest while terming their actions as 'politically motivated'. 

The SCBA has issued another resolution then where they clarified that Aggarwala wrote the letter unilaterally without any consultation with the committee members. Subsequently, around 150 Supreme Court lawyers had signed a resolution seeking removal of the SCBA President for writing letters without authority and capacity on the letterhead of the Supreme Court Bar Association.
