Illegal Gambling Reported At Rash Mela In Dhubri Despite HC Ban

 

GUWAHATI: Reports of open gambling have surfaced at the ongoing Rash Mela in Sapatgram, Dhubri district, despite it being prohibited by law. Numerous gambling stalls have been set up at the event, drawing crowds openly participating in betting activities.

This comes after the Gauhati High Court, on October 4, 2024, imposed an immediate ban on both online and offline lotteries in Assam. The ruling was issued in response to a Public Interest Litigation (PIL) that raised alarms over the growing prevalence of illegal gambling activities across the state, violating the Lotteries (Regulation) Act, 1998, and the Lotteries (Regulation) Rules, 2010.

The High Court’s order stated that only the State Government is authorised to organise lotteries under specific conditions. However, the PIL revealed instances of unauthorised permissions being granted by certain District Commissioners, enabling illegal gambling operations.
The Court expressed concern over the rise in such activities, particularly during public events like the Rash Mela, which draw large crowds during the festive season. It instructed the State Government to enforce the ban strictly, directing District Commissioners and Superintendents of Police to take immediate action against illegal gambling and lottery operations.

Highlighting the social impact, Amicus Curiae H.K. Das emphasised that such unlawful practices disproportionately harm vulnerable populations, particularly during festive seasons. The proliferation of gambling activities can have far-reaching consequences, especially for economically disadvantaged communities.
Additional Senior Government Advocate R.K. Borah informed the Court that 25 District Commissioners had already rejected requests for lottery permissions. However, the Court noted that the State Government had yet to provide a comprehensive response to the PIL. While some District Commissioners have submitted counter-affidavits, the issue remains under judicial review.
The Court has granted the State Government six weeks to file a detailed response, outlining the measures taken to curb illegal gambling. It is expected to issue clear instructions to all District Commissioners and Superintendents of Police, ensuring such activities are eradicated, with swift legal action against violators.
This case highlights the urgent need for vigilance and enforcement to prevent the exploitation of citizens during public festivals and to uphold the law against unauthorised gambling and lotteries.
