The order was passed by a division bench comprising Chief Justice Vijay Bishnoi and Justice Suman Shyam, which also instructed the State to take effective measures to safeguard historical monuments linked to the Ahom dynasty.

The court was hearing a suo motu Public Interest Litigation (PIL) based on a newspaper report dated April 5, 2018. The report highlighted illegal coal smuggling in the Tipam Hills area of Digboi Sub-Division, which led to the destruction of historic sites. The state government and other respondents informed the court that illegal mining activities in the area have now been stopped, and regular monitoring is being conducted to prevent further damage.

During the PIL proceedings, concerns were also raised regarding the preservation of Ahom dynasty monuments. On April 30, 2024, the court directed the State to address the issue, following which an affidavit was submitted by the Director of Archaeology on August 29, 2024. The affidavit stated that a survey was underway to identify historically significant monuments, after which necessary steps would be taken for their protection.

The High Court, acknowledging this submission, ordered the State to expedite the process and complete it within six months. It also directed relevant authorities to ensure continued supervision and monitoring of the Tipam Hills area to prevent any resurgence of illegal coal mining activities.
