Delhi High Court Rejects Petition For Removal Of Jailed Arvind Kejriwal As Chief Minister

 

GUWAHATI: The Delhi High Court dismissed a petition on April 4 seeking the removal of Arvind Kejriwal as the Chief Minister of Delhi while he remains lodged in Tihar Jail after his arrest in a liquor policy case. The division bench of the Delhi High Court ruled that it was Kejriwal's personal decision whether to continue as the Chief Minister or not.

This marks the second time that the High Court has rejected a petition seeking Kejriwal's removal as Delhi CM. The court advised the petitioner to approach constitutional authorities with their concerns, emphasising that it was within the purview of the Lieutenant Governor or the President to address such matters.

The petition was filed by Vishnu Gupta, the national president of the Hindu Sena, who subsequently withdrew the petition and stated his intention to make a presentation before the Lieutenant Governor. Gupta's counsel argued that Kejriwal's arrest had resulted in a "lack of government" in the national capital.

Responding to the petition, the High Court asserted that it was not within its jurisdiction to declare the government non-functional, as that authority rested with the LG. The court emphasised that the LG was fully competent to make decisions in accordance with the law without requiring guidance from the judiciary.

Meanwhile, Kejriwal, despite being in custody, has instructed AAP MLAs to visit their constituencies daily and ensure that the people of Delhi do not encounter any difficulties. Kejriwal's wife, Sunita Kejriwal, relayed his message during a digital briefing.

Kejriwal, who is in judicial custody until April 15 in connection with a money-laundering case, reiterated his commitment to serving the two crore people of Delhi in messages conveyed through his wife. He emphasised various initiatives, including providing a monthly honorarium to women and addressing issues related to water, health, and infrastructure in the city.
